Judge Sides w/ Landfill Developer; says Haralson County Zoning Ordinance is invalid

Haralson County officials say their attorneys are currently reviewing the decision to compile the basis of an appeal of the Court’s ruling.

In a 19-page document issued this week, the judge summarized his findings:

The court declares that the Haralson County zoning ordinance void.
The court orders that the individual commissioners are enjoined from any action to enforce this ordinance regarding the Subject Property.
Since there is no longer any zoning restriction, it further appears to the court that the plaintiff would also be entitled to receive the required zoning compliance letter required by the state regulator.

Haralson County Commission Chairman Ronnie Ridley issued the following statement:

The County received the Court’s decision on the landfill lawsuit late yesterday evening. We are disappointed that the Court’s order favors Solid Solutions position instead of supporting the rights of the citizens of Haralson County. Our lawyers are currently reviewing the decision to compile the basis of an appeal of the Court’s ruling. As soon as that review is completed, the County will take further action. I anticipate that we will aggressively pursue any and all options at our disposal to protect the legal rights of our citizens.

A Solid Solutions spokesperson on Wednesday issued the following statement at the request of WLBB Radio:

“Our attorneys are reviewing the ruling issued by the judge yesterday.

Solid Solutions looks forward to working with the county moving forward.”
