Capital Murder Charge In Infant Death Goes To Grand Jury

A Cleburne County Judge decided Tuesday there is enough evidence to proceed with a capital murder charge against a Bremen teenager accused of killing a 7-month-old Cleburne County boy, according to the Anniston Star newspaper.
19-year old Anthony Wade Killingsworth was charged with capital murder and aggravated child abuse after allegedly injuring his girlfriend’s son while the boy was in his care on May 5th.
The paper reports that Killingsworth’s attorney argued that the capital murder charge was excessive and should be changed to manslaughter.
The district attorneys office pushed for homicide however, stating that ‘intent’ is not only what one does but also what one doesn’t do. Killingsworth allegedly did not call 911 until some time after the infant was seriously injured.
A bond hearing for Killingsworth is set for later this month.
